General Terms and Conditions

1. Scope

The following terms and conditions apply to all orders placed via our online shop by consumers and entrepreneurs.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or independent profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their trade, business or independent profession.

The following applies to entrepreneurs: If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby rejected; they only become part of the contract if we have expressly agreed to them.

2. Contracting party, conclusion of contract, correction options

The purchase contract is concluded with Mandy Jakisch Einzelunternehmen (sole proprietorship).

By placing the products in our online shop, we make a binding offer to conclude a contract for these products. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained in the ordering process. The contract is concluded when you accept the offer for the products in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation by e-mail.

3. Contract language, storage of the contract text

Language(s) available for concluding the contract: German

We store the contract text and send you the order data and our terms and conditions in text form. For security reasons, the contract text is no longer accessible via the internet.

4. Delivery conditions

Delivery options

We ship the products to the delivery address specified in the ordering process.

We only deliver by shipping. Unfortunately, collection of the goods is not possible.

5. Payment

The payment methods available to you are shown in the footer of the shop and in the ordering process. The selection may vary depending on the delivery country and order value. We currently offer in particular the following payment methods.

Prepayment
If you choose prepayment, we will send you our bank details in a separate e-mail and deliver the goods after receipt of payment.

Credit and debit card, Apple Pay, Google Pay, Shop Pay
Payments with Visa, Mastercard, Maestro, American Express and UnionPay as well as via Apple Pay, Google Pay and Shop Pay are processed through the payment service Shopify Payments. The payment is authorised during the ordering process.

Klarna
If you choose Klarna, payment is made via Klarna Bank AB (publ), Stockholm, Sweden. Klarna decides which Klarna payment options are offered to you, for example immediate payment, invoice or instalments. Klarna's terms, which are shown to you in the ordering process, apply in addition.

Other payment methods
Depending on the delivery country, Bancontact, BLIK, EPS, iDEAL | Wero, MobilePay or USDC may also be offered. After selecting one of these, you will be redirected to the respective payment provider and confirm the payment there.

PayPal
To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, identify yourself with your login details and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after the order is placed. You will receive further information during the ordering process.

PayPal may offer further payment options in the customer account to registered PayPal customers selected according to its own criteria. We have no influence on the offering of these options; further individually offered payment options concern your legal relationship with PayPal. Further information can be found in your PayPal account.

6. Right of withdrawal

Consumers are entitled to the statutory right of withdrawal as described in the cancellation policy. Entrepreneurs are not granted a voluntary right of withdrawal.

7. Transport damage

The following applies to consumers: If goods are delivered with obvious transport damage, please report such defects to the delivery person as soon as possible and contact us without delay. Failure to make a complaint or to contact us has no consequences whatsoever for your statutory rights and their enforcement, in particular your warranty rights. However, you help us to assert our own claims against the carrier or the transport insurance.

The following applies to entrepreneurs: The risk of accidental loss and accidental deterioration passes to you as soon as we have handed the item over to the forwarder, the carrier or any other person or institution designated to carry out the shipment.

8. Warranty and guarantees

8.1 Liability for defects

Unless expressly agreed otherwise below, the statutory liability for defects applies.

The following limitations and shortened time limits do not apply to claims based on damage caused by us, our legal representatives or vicarious agents

• in the event of injury to life, body or health
• in the event of intentional or grossly negligent breach of duty and fraudulent intent
• in the event of a breach of essential contractual obligations, the fulfilment of which is essential for the proper performance of the contract and on whose compliance the contractual partner may regularly rely (cardinal obligations)
• within the scope of a guarantee promise, if agreed, or
• insofar as the scope of application of the Product Liability Act applies.

Limitations towards entrepreneurs

Towards entrepreneurs, only our own information and the manufacturer's product descriptions that have been included in the contract are deemed to be an agreement on the quality of the goods; we accept no liability for public statements by the manufacturer or other advertising statements. For entrepreneurs, the limitation period for claims for defects in newly manufactured items is one year from the transfer of risk. The preceding sentence does not apply to an item that has been used for a building in accordance with its usual purpose and has caused its defectiveness.

The statutory limitation periods for the right of recourse pursuant to Section 445a of the German Civil Code (BGB) remain unaffected.

Notice to merchants

Between merchants, the duty to inspect and give notice of defects under Section 377 of the German Commercial Code (HGB) applies. If you fail to give the notice required there, the goods are deemed approved, unless the defect was not detectable during the inspection. This does not apply if we have fraudulently concealed a defect.

8.2 Guarantees and customer service

Information on any additional guarantees that may apply and their exact conditions can be found with the respective product and on special information pages in the online shop.

9. Liability

We are always liable without limitation for claims based on damage caused by us, our legal representatives or vicarious agents

• in the event of injury to life, body or health,
• in the event of intentional or grossly negligent breach of duty,
• in the case of guarantee promises, if agreed, or
• insofar as the scope of application of the Product Liability Act applies.

In the event of a breach of essential contractual obligations, the fulfilment of which is essential for the proper performance of the contract and on whose compliance the contractual partner may regularly rely (cardinal obligations), through slight negligence on our part, on the part of our legal representatives or vicarious agents, liability is limited in amount to the damage foreseeable at the time the contract was concluded, the occurrence of which must typically be expected.
Otherwise, claims for damages are excluded.

10. Final provisions

If you are an entrepreneur, German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

If you are a merchant within the meaning of the German Commercial Code, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you is our place of business.
